Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Planig Tecnologia Ltda. (“Planig”, “we”, “us”, or “our”) governing your access to and use of the Planig platform, website, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Service

Planig is a SaaS platform that lets you schedule and publish content to Instagram, generate captions and hashtags using artificial intelligence, manage multiple accounts, and view analytics. We may add, change, or remove features at any time.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it up to date.

4. Instagram and third-party platforms

The Service integrates with Meta’s Instagram Graph API. By connecting your Instagram account, you authorize Planig to publish and manage content on your behalf. Your use of Instagram is also governed by Meta’s terms and policies. We are not responsible for changes, outages, or restrictions imposed by Meta or any third-party platform.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or abusive purpose.
  • Publish content that infringes intellectual property, privacy, or other rights.
  • Post spam, malware, or content that violates Meta’s community guidelines.
  • Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service.
  • Resell or sublicense the Service without our written consent.

6. Your content

You retain all ownership of the content you upload or create through the Service. You grant Planig a limited license to host, process, and transmit your content solely to provide the Service (for example, to publish it to Instagram). You are solely responsible for your content and confirm you have the rights to use it.

7. AI-generated content

Captions and hashtags generated by AI are provided “as is”. You are responsible for reviewing AI output before publishing. We do not guarantee that AI-generated content is accurate, original, or suitable for your purpose.

8. Plans, billing, and free trial

Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor. Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

9. Cancellation and termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk or legal exposure for us or others. Upon termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, Planig will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Planig harmless from any claims, damages, or expenses arising from your content, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Brazil, without regard to conflict-of-law principles. Mandatory consumer protections in your country of residence still apply where required by law.
